ClassAdapt – Terms of Service

Welcome to ClassAdapt (“we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of the ClassAdapt platform, including our website, educational tools, interactive simulations, and related services (collectively, the “Service”).

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

1. Description of Service

ClassAdapt provides a digital educational platform designed to assist educators in adapting lesson materials, generating tailored learning resources, and deploying interactive educational simulations to support diverse learning needs.

  • Educators must create an account to generate, manage, and deploy resources.
  • Students do not create accounts and may only access specific learning materials or interactive simulations via unique, temporary access links generated and managed by their teacher.

2. Eligibility and Safeguarding

To use this Service, you must be at least 18 years of age, or accessing the platform in a professional educational capacity (e.g., as a teacher, school administrator, or tutor).

Educators are solely responsible for:

  • Supervising all student interactions with materials accessed via shared ClassAdapt links.
  • Ensuring that link distribution complies with their local school, institutional, and regional safeguarding policies.

3. Account Registration and Security

Educators must register and sign in using authorized Google authentication. By creating an account, you agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain the security and confidentiality of your Google account credentials used to access ClassAdapt.
  • Accept full responsibility for all activities, data modifications, and link distributions that occur under your account.

We reserve the right to suspend, restrict, or terminate accounts, without notice, if we suspect unauthorized access, security breaches, or a violation of these Terms.

4. Intellectual Property Rights

Important Notice regarding ClassAdapt Assets:

All interactive simulations, HTML5/JavaScript source code, CSS styles, functional logic, algorithms, user interfaces, graphics, audio, animations, and text contained within the Service are the exclusive intellectual property of ClassAdapt (or our licensors) and are protected by copyright, trademark, and trade secret laws.

A. Our Proprietary Protections & Restrictions

Except for the explicit, limited license granted to your students to interact with simulations via teacher-generated links, you are strictly prohibited from:

  • Copying, modifying, replicating, distributing, or creating derivative works of our interactive simulations or platform code.
  • Reverse-engineering, decompiling, or attempting to extract the underlying source code, scripts, or algorithms of the Service.
  • Scraping, data-mining, downloading, or caching our simulations for use offline, on alternative learning management systems, or on external websites without our express written consent.

B. User Content and Materials

Educators retain all ownership and intellectual property rights to the original text, lesson plans, and media files they upload to ClassAdapt (“User Content”).

By uploading User Content, you grant ClassAdapt a worldwide, non-exclusive, royalty-free, limited license to process, host, store, translate, and adapt your content solely for the purpose of providing, optimizing, and operating the Service for you and your students. You represent that you possess all necessary rights and permissions to grant this license.

5. Acceptable Use Policy

You agree to use ClassAdapt strictly for lawful, educational purposes. You explicitly agree not to:

  • Upload, generate, or distribute content that is unlawful, harmful, threatening, abusive, defamatory, or violates student safeguarding principles.
  • Use the Service to infringe upon the intellectual property, privacy, or publicity rights of any third party.
  • Deploy automated systems (including bots, spiders, or scrapers) to access, monitor, or copy platform assets.
  • Attempt to bypass, disable, or interfere with the security features, access controls, or hosting infrastructure of the platform.
  • Publicly publish or index student access links in a manner that allows unauthorized third parties to access classroom materials.

Violation of this section may result in the immediate termination of your account and legal action for intellectual property infringement.

6. Student Access and Link Distribution

Students are granted a temporary, non-transferable, revocable license to view and interact with ClassAdapt materials solely for educational purposes via links provided by their teacher. ClassAdapt is a processor of data during these interactions and is not responsible for how access links are distributed, shared, or managed outside intended classroom or homework settings.

7. Service Availability and Modifications

While we strive to maintain a reliable platform, ClassAdapt is provided on an “as-is” and “as-available” basis. We do not guarantee that the Service, including individual interactive simulations, will be completely error-free, uninterrupted, or fully compatible with every browser, operating system, or school hardware configuration.

We reserve the right to update, modify, refine, or temporarily discontinue specific simulations or platform features at any time to improve performance, security, or educational accuracy.

8. Limitation of Liability

To the maximum extent permitted by applicable law, ClassAdapt, its founders, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, but is not limited to:

  • Loss of data, uploaded teaching materials, or customized lesson configurations.
  • Direct or indirect classroom, institutional, or instructional disruptions resulting from technical downtime or software errors.
  • Pedagogical or grading outcomes based on the use of AI-adapted content or simulations.

Your use of the platform and reliance on any adapted materials is entirely at your own risk.

9. Termination of Use

  • By You: You may stop using the Service and request the deletion of your account at any time.
  • By Us: We reserve the right to suspend or terminate your access to ClassAdapt immediately if you breach these Terms, misuse our intellectual property, or if continuing your access poses a security or legal risk to us or our users.

10. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, platform features, or legal obligations. When changes are made, we will revise the “Effective Date” at the top of this page. Your continued use of ClassAdapt following the posting of updated Terms constitutes your binding acceptance of those changes.

11. Governing Law and Jurisdiction

These Terms, and any disputes or claims arising out of or in connection with them, shall be governed by and construed in accordance with the laws of the United Kingdom. Any legal proceedings or disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
